This privacy policy applies to the use of the website and the services provided by WorkOnYourTerms (a Daisy & Goliath B.V. brand). The start date for the validity of these conditions is January 21, 2021, with the publication of a new version, the validity of all previous versions is canceled. This privacy policy describes which data is collected by us, what this data is used for and with whom and under what conditions this data can possibly be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have with regards to the personal data you provide us with.

WOYT processes your personal data carefully, securely, and confidentially.   We are committed to protecting your privacy. The rules on protecting your privacy are laid down in the General Data Protection Regulation, with the Personal Data Protection Authority supervising compliance with the law. WOYT acts within the framework of the law.

  1. Privacy statement structure

WOYT is responsible for processing your data, which it receives in the performance of various activities. In the sections below, we describe which personal data we process and why we do this. We also explain which services we process the data for, and on what basis we can do so. The sharing of data with other parties is explained, as is the processing of personal data outside the EU. The security of personal data is addressed together with retention periods. Finally, a section has been added about your rights as a data subject and the possibility of lodging a complaint or contacting WOYT. 

  1. What are personal data?

Personal data are any data that can be traced back to a certain person. Examples include your name, address, phone number and email address. Personal characteristics, too, can be classified as personal data. 

  1. Are you obliged to provide personal data?

In some cases, yes. If you decide to use our services or order a product from us, these data are necessary. Only then can the contract be concluded, and we can deliver the products. In some cases, it is also necessary to obtain data from your employees to be able to carry out a certain project properly. This mainly concerns names, telephone numbers and email addresses to be able to contact people, when necessary, over the course of a project.

  1. What about data collected from others?

Inside the web store, WOYT does not collect data from third parties. The only data we process are the data we receive from the data subjects themselves. For our other activities, data are collected from the parties involved, and also via their employers, which could be managers or HR departments.

  1. Who is the controller of personal data?

When ordering products, WOYT is the legal data controller.

When a project is started in a company in which work is carried out for and on behalf of employees, the customer is the data controller. WOYT does not employ a data protection officer.   1. What personal data do we use for our services and products?

Several services and plug-ins are used for the website and the operation of the website (www.workonyourterms.company). Below is an explanation of how to use these services and plug-ins. 

Cookies

Cookies are used for the best possible operation of these websites. This statement first explains what cookies are. Then it will be discussed which cookies are used and why. 

A cookie is a file that is sent by a website (in this case www.WorkOnYourTerms.company) and placed by the browser on your computer’s hard drive. There is then a cookie on the hard disk. Our website places cookies from Kajabi. The information that Kajabi receives from the cookie is analyzed. This information is anonymized as much as possible. Kajabi will only share the information obtained with third parties when they are legally obliged to do so or insofar as third parties process the information on behalf of Kajabi. Kajabi has not received permission from us to use information for other services. Kajabi is an American company and stores the information it collects in American servers. Work On Your Terms would like to gain insight into the use of the website to optimize it for use by our visitors. Kajabi is used for this. This service analyzes the data of website visitors. An IP address is not visible and therefore cannot be traced back to a person to us.  

Social Media buttons

The various social media channels use code, with which they place cookies via the site. These social media channels collect information that they can obtain through the cookies. Disable and delete

You can disable or delete cookies. For this you must go to the settings of your browser. Are you stuck? Then use the browser’s help function. Work On Your Terms would like to gain insight into the use of the website to optimize it for use by our visitors. Kajabi is used for this. This service analyzes the data of website visitors. An IP address is not visible and therefore cannot be traced back to a person to us. Kajabi also has a policy that can be found online.

Social media channels

WOYT uses different social media channels, namely: Facebook, Pinterest, LinkedIn and Instagram. To make it as easy as possible for the customer, WOYT uses buttons, links and / or contact forms. Free downloads from our website

You can download an e-book and a checklist from our website. For this we ask for your email address so that we can send you the aforementioned items. Based on the e-book and checklist, we can send you e-mails about our services. You can always unsubscribe or object to this.

Programs or other online offers

Even when you register for a program or other online offer, we need your e-mail address to send you the link to the program or other online offer. To allow you to participate, we need your email address and name. In this way we can provide you with an account. In addition, we will keep you informed of our offer via emails. In addition, private groups for programs or other online offerings can be created on social media. Here you can, for example, ask your questions. You will be added when the course or program starts. 

Your account

You need an account for the programs or other online offer. The following data is stored here: name and e-mail address. A password is automatically generated for you so that you can log in securely. You can change this password once you are logged in.

It may happen that we also need a physical address for several programs or other online offerings, for example to send an information package. We only use your address details for this. This is explicitly stated when registering for the relevant program or other online offer. Your account also includes a log in which we can record how often you log in and from which IP address. We will not use this information until you contact us to report abuse of your account. 

Contact Form

You can ask questions via the contact form. We ask you to fill in your name and e-mail address, and of course your question. In this way we know who the question comes from and we can answer the question by e-mail. When you enter your telephone number, we may also contact you by telephone. You are not obliged to provide your telephone number.

We can also use this information to send you offers or invoices. You will receive this at the e-mail address you provided. 

Pay

We use an online payment service to make a payment as easy as possible for you. This allows you, for example, to pay for your order with Ideal or a credit card. To make this possible, your payment details, IP address, internet browser, device type and in some cases name and address details are shared with them. We do not see this information. 

Accountancy

We must keep accounts for our company. We use an accounting program for this. Here we collect the invoices that are created after you placed an order. As a result, your name and address details are known to our accounting program. 

Others

For the other services offered by WOYT, we also process personal data collected during various activities such as coaching. 

  1. On the basis of which principles do we use your data?

In order to be able to store and use your data, WOYT must have a basis. You can see this as a condition that is necessary to be allowed to process data. The basis (s) for us are:

  • The data e-mail address, telephone number, account for the programs or other online offer and payment data are necessary for the execution of the agreement that has been entered into with you.
  • The name and address details are sometimes necessary for sending an information package, which we will explicitly inform you about when registering.
  • The (company) name and name and address details are necessary for compliance with legal obligations under tax law.
  • We ask permission from you to send the e-book or checklist. You can always withdraw this permission.
  • We have a legitimate interest in sending direct marketing to existing customers. In any form of direct marketing that will be sent, we will weigh up our marketing interests against the privacy damage of you.
  1. Do we share the data with other parties?

WOYT does not sell your data to third parties and will only provide / deliver it if this is necessary for the execution of the agreement with you or to comply with a legal obligation. With companies that process your data on our behalf, WOYT enters into a processor agreement to ensure the same level of security and confidentiality of your data, as it does itself. WOYT remains responsible for these processing operations. 

  1. What is the retention period of my data

WOYT does not store your data longer than is strictly necessary to achieve the goals for which it collected your data. The retention period (s) are:

  • The data required to comply with the administrative obligations arising from legislation and regulations will be stored for 7 years after the invoice has been paid after completion of the assignment.
  • In the case of digital services (downloads and online programs or other online offerings), a legal retention period of 10 years applies.
  • The account you have created will remain in existence as long as you want. This account will be deleted immediately when you want the account deleted. For this you can contact us.
  • The data of the created user for maintenance and adjustments to the website will be kept for one year after termination of the agreement for possible future adjustments.
  • All other data, which is not stored for the legal administration obligation, the account or the created user, will be deleted six months after the conclusion of the agreement.
  1. What are my rights

You have the right to view the stored personal data, to correct it, to have it deleted, to have it transported to another company that needs your data, to minimize it to only the data that is necessary and you have the right to object against the storage of the data. If you want to use one of the rights mentioned above or if you have a question, please contact us.

WOYT however, does not affect the use of data by social media channels.

Conversation Workouts takes the protection of your data seriously and therefore takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. WOYT considers it important to have satisfied customers. Even if we do everything we can to ensure this, it may be the case that you as a customer are still not satisfied.
